your carry marks are out.it's in front on law dept. Sorry if u've been checking my blog every hour just to see ur carry marks... my home computer became corrupted so i had to re-do your carry marks, re-checking and all so it took a while.

nevertheless, i think your marks are quite ok.any inquiries about ur marks ask me by tomorrow key.i think highest was 50. but anyhow, the final will be the determining factor.everyone can pass blm.but scoring is up to u.

Mooting sessions

For 1 p.m sessions, the venue would be at G-01 unless it is occupied.
For the rest of the sessions, it would be at the usual class venue.

As for who is the senior, junior and rebutter it is totally up to u.

Duration of submission would be 8 minutes each for the counsels... and 4 minutes for rebuttal. 20 minutes each side including Qs from me along the way. Each cannot exceed 8 minutes. It's ok if u want to use less than 8 minutes but make sure u have covered all ur submission well. Total for each session is 40 minutes.

HOW TO DO MOOTING

OK, some tips from the net on how to do mooting...

Don't panic!

Okay. So you've got your first mooting problem. Aaaagh! Where to begin?
Well, first, lets make a few assumptions.

1. you're a law student
2. you know the rules about precedents
3. you know how to find law cases in the library, and how citations work

If any of the above aren't true, then you will need to read a book on the basics of English law before you start mooting, such as the excellent Learning Legal Rules or Glanville Williams' Learning the Law. How to use a Law Library by Jean Dane and Philip A Thomas is also useful to refer to.

It is usually best to work initially in a pair on the moot problem until you can identify the issues and split up the work fairly. The first thing to do is to look carefully at the problem, try to summarise it, and work out what area, or areas, of law the problem deals with. e.g. crime / tort / property / contract / employment law.

Getting started...

When this is done, there are usually two places to start:

1. You can look the area of law up in a law textbook, read the chapter or section on it, and find out the names of some relevant cases, as well as getting a picture of what the case is about and what the real issues to be argued are. There are a number of general textbooks on legal subject areas which are useful to get you started. It is vital that you use the most up to date version of any textbook. Information from a textbook more than five years out of date should be double checked to see whether any more recent cases have affected the legal position.

2. If the moot problem mentions the names of cases - and most do - you can look these up directly, and reading through them may give you a clearer idea of the likely problems to be encountered in the moot. Some judges realise the importance of their judgments to law students, and will go out of their way to clearly summarise the legal position in the relevant area of law. Lord Denning judgments can often be a blessing (unless he is talking about proprietary estoppel!)

The judgment in a case will refer to other cases, which may also be worth looking up.

Where the case is in the Court of Appeal or below, you should check that there has not been a subsequent appeal and different decision. Some well kept sets of law reports will tell you this via stickers in the margin. CD rom searches where available (e.g. the All England Case Reports on CD rom published by Butterworths) are a useful method of checking whether a case contains the most up to date statement of the law - type in the case name as a search string and this should produce a list of subsequent judgments which have mentioned the case concerned.

On-line search tools such as Lawtel can be useful for checking for up to date cases, if your institution subscribes to the service. There are also free sources of recent legal information on the internet - some are listed here.

Working out your main argument

Okay, after a quick look at the cases or textbook, you should be beginning to get an idea of what the case is about. The next step is to work out exactly what you are trying to argue, so that you can begin to identify and find authority for points in your favour. Unfortunately, this is not easy, and is a point where many first time mooters can become very confused.

You should have been informed at the time of receiving the moot problem whether you are the appellants or respondents, and whether your case is in the Federal Court or the Court of Appeal (or occasionally, a different court or tribunal). If you are not sure, ask.

* Appellants, Court of Appeal case

You are appealing against the decision of the judge at first instance, i.e. the original court where the case is tried. This is generally a High Court judge, depending on the type of case. Your must argue against the reasoning of the first instance judge, and support the grounds of appeal.

A Court of Appeal case is often won by careful use of Federal Court authorities, which are binding on the Court of Appeal, if they can be shown to be appropriate. The Court of Appeal will also generally follow its own previous decisions.

* Respondents, Court of Appeal case

You must respond to the grounds of appeal put forward by the appellants, as your aim is to have the decision of the original court reaffirmed. You must argue the opposite of that stated in the grounds of appeal.

Any decisions in the Federal Court which support the first instance decision are likely to be binding on the Court of Appeal, and respondents should carefully argue why such authorities should be applied in this case.

NOTE: Appellants/Respondents/Claimants/Defendants

Some confusion will inevitably arise over terminology at this point. The claimants (referred to in older cases as the plaintiffs) are the party which initiated the original action, but are not necessarily the appellants. Here is an example.

1. Smith sues Jones over negligent work.
* Smith = claimant
* Jones = defendant
2. Smith wins. Jones appeals against the decision to the Court of Appeal
* Smith = claimant and respondent
* Jones = defendant and appellant
3. Jones wins. Smith appeals to the Federal Court.
* Smith = claimant and appellant
* Jones = defendant and respondent

This shows why it is essential to tell the judge whether the appellant is the claimant or defendant, but more on that later.

It is often useful to write down exactly what you are arguing.

e.g. If a ground of appeal is
The weapon did not constitute an 'offensive weapon' under s.1(4) of the Prevention of Crime Act 1953.
and you are the respondents, your argument will be
The weapon did constitute an 'offensive weapon' under s.1(4) of the Act.

Splitting the work

Once you have identified the arguments to be made, it is possible to split the work between the two advocates, and work alone. It is, however, very beneficial to work together, and have a working knowledge of each others' arguments for when it comes to the moot.

Usually, a problem will have two grounds of appeal. If there are more, you will have to decide how to split them. At this point you will have to decide who will be lead, and who will be the junior advocate for the moot. The junior generally has less speaking time, but, in the case of the respondents, gets the final word.

It is sensible for the junior to take the ground which appears to be the least work, or to take only one out of three grounds. If, after sharing the load, it appears that the problem has been unfairly split, it is important to rectify this, or you may find that later, insufficient speech time will be devoted to a particular point in the moot.

Supporting an Argument

There are a number of ways to support a legal argument:

1. Authority
2. Reason and logic
3. Policy arguments

By far the most important of these is the first. Indeed, reason and logic as well as policy arguments should be used so subtly that the judge is not aware of their existence. Any legal argument should be firmly founded in authority.

Care needs to be selected in the choice of authority, as the effect will depend on the court in which the case is heard and also the judge's own preference.

Mooters should always refer to case law carefully - there are embarrassing mistakes to be made!

If one of the main Malaysian cases appears to be based on an overseas authority then it is probably acceptable to refer to it. It may be prudent to introduce the case by saying 'although not binding on this Court it may be of assistance to examine the judgment in...'

A note must be made on the use of textbooks and articles. Use textbooks rarely. A textbook may only be used if it is a leading authority on the subject, as defined by practising lawyers, not lecturers. Your course textbooks will almost certainly not be considered good authority. Practitioner texts which could be considered can often be identified because they usually have the author's name as part of the title! Examples include:

* Snell's Equity
* Chitty on Contract
* Emmet on Title
* Megarry's Manual of the Law of Real Property
* Clerk and Linsell on Torts
* McGregor on Damages

The way around this is to find out which case the textbook writer is using to support their own arguments (there generally is a case) and quote from that.

Everything you put to the judge in a speech should be supported by some sort of legal authority. The judge is liable to ask, quite rightly, 'What is your authority for that counsel?' You cannot make up arguments out of thin air. The only possible exceptions to this are a simple logical statement arising from the facts stated, or a comment on policy.

The facts of the case are not in dispute

No matter how little you dislike the fact that Johnny X was found to be dishonest, if it states this in the facts of the case, and it is not disputed in the points of appeal, you cannot argue against it. The appellate court does not have access to the evidence which was in front of the original court, and so cannot dispute the findings it made on the basis of that evidence.

The moot argument is on the law, not on the validity of any factual evidence.

Court Etiquette

The language of a courtroom is different from that used in everyday speech, and you should try and formulate phrases as you might expect a barrister or judge to say them. Colloquial phrases, such as 'Okay' and 'All right' are not acceptable. If a judge corrects your mistaken interpretation of a case, the correct response would be something like 'I am grateful for your Lordship's assistance' rather than 'OK. Ta.' Speaking slowly often allows you to think of what might be appropriate to say, rather than how you might ordinarily respond.

Thanking people is always a good idea, even if you would rather throttle them! It is also professional to ask the judges permission at various stages of the speech: 'With your Lordship's permission I would like now to...'

Another point to remember is that your role is to assist the judges in their decision making. What you say and do is for the judges' benefit, so keep a careful watch on them to see if they are following your argument. Allow them time to find a citation, unless they indicate you should go on. Interact with the judge. Talk to them, not at them.

As an advocate, you are giving arguments based on legal authorities to aid the judge. You are at no stage giving your own opinion, merely restating the opinion of others. The opinion of the barrister is irrelevant for the court to make its decision. As such, you should never tell the judge what you think, suppose or suggest. You must merely submit humbly that the judge should adopt your interpretation of the authorities given.

Therefore the phrase 'My Lord/Lady, I submit that' should occur fairly frequently in a good moot speech.

The speech should also give the full citation of a case as soon as it is mentioned, and the advocate should always ask the judge if he/she would like a summary of the facts of the case.

e.g. 'A further authority which supports this is the case of Smith and Jones which can be found in the second volume of the 1942 Weekly Law Reports at page 132. Would your Lordship like a summary of the facts of the case?'

Putting Together the Speech

The starting point of your argument should be the points of appeal as stated. The appellants must prove those points of appeal to be correct using legal authority, and the respondents must respond to the appellants' arguments. Select around four cases per point (or as many as are necessary / permitted by the mooting rules) and then base your argument around these.

* The Lead Appellant

It is usually the job of the lead counsel for the appellants to introduce the advocates to the court, and to summarise the case. Make sure you prepare a summary - don't just read from the moot problem.

Introducing the advocates could go as follows:
'My Lord, I am John Smith, and this is Tom Hughes. We are counsel for the appellant, Mr X / X plc, who is the claimant in this case. My learned friends opposite Mr Jones, and Mr Baldwin, appear for the respondents Mr Y / Y plc / the Crown.'

(Always refer to R / Regis / Regina as 'The Crown'. The case name R v. Smith should be read in a moot as 'The Crown and Smith'.)

'Would your Lordship like a brief summary of the facts of this case?'

(The judge will almost invariably reply 'yes'.)

'In this case, X plc...(give a brief summary of the facts stated, including details of the decision at first instance, and the grounds of appeal.)'

The lead appellant will then generally state which ground he/she will be dealing with, and commences the argument.

The speech can then take a number of different forms, and it is important that advocates are encouraged to develop their own style. It is often useful to take the judge through the relevant law first, before proceeding to the main supporting case.

Do not mention any arguments against the respondents cases - this can be done in the five minutes reply time later.

* The Junior Appellant

The junior counsel should generally have his/her own ground of appeal to deal with, and should not attempt to embellish arguments made by the lead counsel. No introduction is needed, save possibly:

'My Lord, I am John Smith, junior counsel for the appellants in this matter. I shall be dealing with ground two of this appeal, which states that...'

The argument can then progress in a similar way to lead counsel's arguments.

* The Lead Respondent

The role of the respondent is a slightly different one. Although the respondents can, and usually will, cite their own cases, their main role is to respond to the arguments put forward by the appellants. The respondents' speeches should therefore be fluid, and adapted to answer the points made during the appellants' speeches.

* The Junior Respondent

Junior counsel will follow on from the lead, but will usually deal with a different point of appeal. The junior respondent will be the last person to speak for the respondents and the speech may therefore end with a brief summary of junior and lead counsel submissions, although some judges are very unsympathetic to any repetition.

* The Appellants 'Right to Reply'

In most moot competitions the lead appellant is then given some extra time to respond to the respondents' arguments. This time should be used to rebut the respondents arguments, and not merely to restate the case made earlier.

Discrediting a Legal Argument

There are a number of possible ways to do this

1. Distinguishing the case - this means that you argue that the case cited is in some way dissimilar to the current one so that the judgment made in the case is irrelevant. This can be done either by showing material (i.e. relevant) differences in the facts of the two cases, or by showing that the case cited was based on a different set of laws or regulations.

2. Errors in citation - you may be lucky enough to spot an error in the citation. Possibilities include:
* citing an Court of Appeal judgment where the case went to the House of Lords who found differently - the House of Lords decision effectively overrules the Court of Appeal decision
* citing a dissenting judgment - this is the judgment of a judge who was in the minority, and has no legal authority. Mooters should take care to avoid this embarrassing mistake - check that the conclusion of the judge is the same as the final verdict - usually printed at the end of the case report
* quoting from the headnote or arguments of counsel - the 'headnote' is the section providing a summary at the start of a case report. Some reports also give extensive coverage to the submissions of counsel. Whilst these may be of assistance in preparing the moot, they should never be used in a moot speech as they carry no legal authority

3. Finding a later/more superior case which disagrees. This is concerned with the rules of precedent. A later judgment, or one in a higher court will supersede the earlier/lower one.

4. Logical/legal flaw - careful reading of the case or statute may suggest an error in a line of argument, or that it does not flow logically from other authorities cited.

Sorry for the delay. This is it, it's not that hard :). And it does not matter if you haven't learn 'mistake' yet in contract. Mmg in mooting u have to do some research. Last sem they had to do breach of promise to marry under Law Reform Marriage Act. So be very thankful :p As for who is the appellant and respondent it is as what ive announced in class. The first pair wud be appellant, against the second pair who wud be the respondent.

Syed v Art International Ltd.

In The Court of Appeal

Syed found a painting in the attic of the family home which, together with its contents, he has just inherited. Syed took the painting to an art expert who identified it as a painting entitled "Deer at Bay" by Landseer. The expert valued the painting at RM130,000.

Syed told a friend of his, a reporter at the local newspaper, The Malay Mail, about what had happened. The next week the newspaper reported what had occurred under the headline: "Local Man In Big Art Find".

Mould, the managing director of Art International, read the news piece. He thought that the art expert had grossly undervalued the work which he knew had been in Syed's family some years ago. Mould decided to offer on Art International's behalf to buy the painting, being confident that he could make a quick and easy profit on its resale.
On the 30th of June, Mould wrote as follows to Syed:
"Art International hereby offers you the sum of RM130,000 for the purchase of the painting whose discovery was reported in this week's The Malay Mail. Please send your acceptance of this offer to the registered office of this company."

Syed immediately posted a letter of acceptance of the offer. The letter was posted to Art International's registered office but for some unknown reason it did not arrive there for a fortnight, arriving on 13th July.

A day before they received Syed's letter, Mould read the following news item under the headline: "Local Man in Big Art Error". The news item indicated that the painting discovered by Syed was not by Landseer but by a hitherto unknown artist. As such it was worth no more than the value of its frame.

Mould immediately sent a fax to Syed revoking Art International's offer. That fax was read by Syed at 5pm on 12th July. Subsequently, Syed, who claimed that there was a binding contract between him and Art International for the sale of RM130,000 of the painting which he had discovered in the attic, sought unsuccessfully to deliver that painting to Art International. On each occasion, Art International refused to accept the painting or to pay for it.

In an action for the agreed sum under the contract by Syed against Art International, the trial judge, Hishamuddin J., held that there was no contract between Syed and Art International because:

(a) Art International's revocation of its offer was effective before there had been an effective acceptance by Syed; and
(b) Even if that was not so, the mistake under which the parties were labouring was such as to render any apparent contract void and unenforceable.

Syed now appeals both points to the Court of Appeal.

I wud also like to apologise to group 15 and group 2 as our class are always cancelled or i wud come in late. the main reason is that i live in gombak.. so it wouldnt matter if i go out at 730 pm, i would still be stuck in traffic all the way to nilai. and lately i'm not feeling very well.got mcs but if i take it then u guys wouldnt be able to finish your excercises,etc2.no matter how annoying u guys cud be, i love all of my students.n i care about the workload, and whether u cud undstd what im teaching or not.so, sorry ek.for group 1, thanks for giving great co-operation when mdm jam came to observe us.u guys are great (cuma salu bgn lmbt tak dtg kelas kan?!).

To the readers if you leave a note at the tagboard. just leave a note then refresh it... cuz if u dont it wont come out. To Hazwan, thanx for all ur guidance(tru hp) while I was in Kuching... it was really helpful and i really like going there.

To students at Gombak... people say lecturers doesnt matter but i believe that it does... it will influence your interest in the subject (at least it was so for me), so asking tips from ur seniors wouldnt hurt. maybe ur new so it'll take time to adjust.. the distance, time and everything. but i always like iiu gombak... jogging, swimming, canoeing, ping pong, silat... i joined everything that im interested it. Mdm won silat tempur remaja puteri tau under karnival rakan waja diri for IIUM. and always wakil mahallah for pingpong... and always tak menang.hahaha... mdm jadi actress mock trial dulu.small role though.but it was fun.

And even if i didnt participate... i would watch the iiu dramas, go to the fabulous ummatic week, take a walk around iiu, make friends with the cleaners.

The secret to life is... MAKE THE MOST OUT OF IT. enjoy and try to absorb and learn from everything around you.students life should be balanced.serious and fun.

Life would be happier if you are happy with yourself.

Salam everyone...
Hope u guys are studying for your exam.the last consultation would be MONDAY.cuz tuesday i have to invigilate for exams so i wont be around. plus, it would be too late.no smses would be replied to on tuesday.

U guys should have similar marks with your group for group exercises, library quiz and case report writing. and similar marks for BOA with your partner. if u find these to be different please see me at the law general office by MONDAY.otherwise ur marks would remain the same.

The best method of studying would be to go through everything and further exercises made on your own on statutes and cases.just pick any section, pick some phrases and try to do like the exercise we did in the class.similar with cases... just go to the library,pick some cases and try to extract all the thing we have learnt. because BLM is a skill. it's not something u should memorise but something u should know how to do. Usually the students would pass, but would not score high.just average. it's easy actually if u know how to apply. and unfortunately those with high carry marks would not do as well in their finals (usually, xtau nape, overconfident kot)... so those with low marks... u have just as much chance as those who scored in their carry marks... dont give up. if u perform i wont hesitate to give u A :)i do advise u to read CAREFULLY the questions as they can be very tricky.

MOOTING
It's nearly over, mooting. I know it was torturous. I wish I do not have to grill u during mooting. But I have to for your sake. In reality, when u practice (become a lawyer), there's no room for mistakes. Mistakes will cost you... time, money or even life. I know it sucks when you have worked so hard yet you lost. But in reality it does happen. Sometimes the law is not on your side even though you have tried to go the furthest. Sometimes u have to accept that you did not make full use of the law. And sometimes u have to realise that u did interpret the law wrongly. But then again, this is just the matrix level... cheer up! Your marks will be based on ur submission, not whether u win or lose.

I do apologise if in the process of judging, i have offended any of u. Actually sometimes my question is irrelevant.. i just want to see u stick up to ur argument or simply back off ;) It's good to see that some of u have to courage to answer.
Sometimes during the sessions, both teams are really good and fully prepared... which makes it more difficult for me... i know u've worked like crazy to prepare ur bundle and submission... which of course, keep me going when i feel like crazy listening to 13 sessions... ON THE SAME MATTER over and over again... BUT out of respect for u guys, for the hard work, i DID listen carefully to u guys. and out of love, i criticize u guys. Never did during the mooting session that i purposely being mean to u. I was firm, but mean? i did not think so.i think hajar suprised me the most when she immediately thanked me lepas abes mooting. ait, salu org kene amek masa proses criticism... mature and open minded nyeee dak hajar baju ijau ni.

Mistakes during mooting (just for discussion sake):
1.jgn takut bila mdm tny nape guna kes lama, nape guna english case.boleh je. be confident.

2.ramai rely on s.24 (a) Contract Act, forbidden by law... tapi ramai tak cakap 'law' tu. maknanya bila dorg guna sababumi dorg tak phm kes tu.s.24(a) means u must show adanya law yg tak bg promise masa kawen. Ramai jugak yg berjaya guna s.24(b) dgn s.69 LRA tu... bagus ler.

3.respondents patut guna not against public policy or immoral tu kuat2.sbb part ni, law can be on their side.

4.appellant patut guna s.24(b) and s.69 lah... tu yg paling power.

5.ramai jugak yg tak submit serupa bikin. maknanya submit ckp lain dr yg tulis. sbnrnya takkan dibenarkan berlaku! tapi mdm bg can sbb nmpk mata bengkak2 x tdo mlm.

6.ada gak yg ada very3 good authorities tapi tak reti nak guna. aiyak... guna baru la mooting namanyeee.

Overall i hope it has been a good experience for u. mooting in real life snanye judge tak byk ckp sgt, haha.tapi mdm penah tagging judges kat high court shah alam. dorg ada yg super garang lah sampai lawyer menangis.

1. The cover page, should be as what she had mentioned, refer to her handouts please. And of course changes are to be made as to the name of the parties, counsels and also the name of the court. Don't follow ur seniors. Follow what she had taught u.

2. Second page would be index. Again, refer to the handouts given. I think it's clear.

3. Dia tak ajar ni but just so that it would be easier for me to refer to, the third page should be the brief facts. Just state the facts of the case as given to u.

4. Outline of submission. So that I'd have a clue of what u're saying ;)

I've seen tremendous improvement from Group 6 today. They asked a lot of questions and have a lot of comments in the public speaking session. This is good. Asking means u are thinking. Which is good coz students ARE supposed to be thinking a lot. And u would improve your English as well. Personally, I feel that all CFS law lecturers are very very sincere and are committed to teach their students. and they love their students very much.

To improve ur written English, ur written tests... u have to read a lot of English books. If u are a beginner, u can start with Enid Blyton books... they are for children actually, but they are interesting and would help to bulid your english. Then you can move on to other fiction books... if u are the romantic type, perhaps Ann of Green Gables series... psycho scary books like Stephen King's, mysteries like Agatha Christie's, conspiracies like Dan Brown's, Islamic books like Harun Yahaya. I have tons of books. English, Malay and Indonesian. I'm a self confessed nerd. The Americans call those who loves to read as nerds right? But to think back in Islam, we call them 'orang berilmu' coz Islam doesnt teach us to mock people with knowledge. Knowledge is sacred in Islam. Beza, kan. When u read a lot of English books, ur written English would automatically be good. Trust me.

To improve on speaking in English... you just have to talk in English a lot. there's no other way. that's why we do public speaking, push u to ask questions coz u have to get used to it. rugi u have all the knowledge but u cant share with the non-muslims especially the foreigners because of language barrier. Once I went to a Global Youth Camp organized by British Council. 10 participants from Malaysia, the rest from UK, Philipines, Vietnam and Indonesia. I had to present about Islam... so I told that in Islam we have akhlaq (morals and virtues), aqidah (belief) and hudud (shari'ah laws).I told them that Islam is a very very comprehensive religion that it covers all, even to the way we should eat. They were extremely interested in Islam and one of them said to me : Islam is a very clever religion. I told him: thank you. And he said: hey you're not the one who created Islam... hahaha. Allah is Great right.

So when you learn something. Don't just think this is for the marks. What you learn should be something useful that u see the link to apply the knowledge everywhere you go.

SEREMBAN: Seorang pensyarah universiti yang disaman ibu bapanya kerana tidak memberi nafkah kepada mereka memberitahu Mahkamah Tinggi Syariah, di sini semalam gajinya tidak cukup untuk menampung perbelanjaan bulanan keluarganya.

Raja Suzana Kassim, 39, berkata gaji kasar RM4,400 sebulan tidak mencukupi untuk menampung semua perbelanjaan dan terpaksa ditampung pendapatan suaminya, Zulazli Hashim, 43.

Dia turut memberitahu mahkamah mengenai beberapa pinjaman bank, termasuk pinjaman peribadi yang diambilnya, selain gaji diterimanya dibelanjakan untuk makanan, pakaian dan keperluan lain serta membayar insurans pendidikan anak.

Raja Suzana berkata demikian dalam perbicaraan untuk membuat taksiran mengenai kemampuannya membayar nafkah sepanjang hayat kepada ibu dan bapanya.

Tahun lalu, Raja Suzana dan suami bersetuju memenuhi tuntutan ibu bapanya, terutama berkaitan nafkah sepanjang hayat dan membenarkan ibu bapanya mendiami rumah di Kampung Jiboi Baru yang sudah dijual kepada orang lain, tetapi disewakan semula dengan sewa dibayar Raja Suzana.

Pada April 2007, Raja Suzana dan Zulazli sebagai defendan pertama dan kedua menghadapi tuntutan daripada pesara, Kassim Othman, 72, dan isterinya, Fatimah Salleh, 64, kerana didakwa memungkiri janji dan mengusir mereka dari rumah yang dipindah milik kepada anak dan menantunya.

Dalam pernyataan tuntutan itu, Kassim menyatakan beliau dianugerahkan sebidang tanah di Kampung Jiboi Baru, Ampangan, pada Ogos 1971 serta mendirikan sebuah rumah dan membesarkan lapan anak, termasuk defendan pertama.

Pada 1993 Raja Suzana serta Zulazli mendirikan rumah tangga dan pada 2002, Kassim memindah pemilikan tanah kepada defendan selepas mereka berjanji, antara lain menanggung nafkah plaintif selagi mereka hidup serta membenarkan kedua-dua plaintif tinggal di rumah itu.

Bagaimanapun, defendan memungkiri janji dan mengabaikan kebajikan plaintif.

Pernyataan tuntutan turut menyatakan defendan pertama melakukan kekasaran terhadap plaintif kedua menyebabkan dia cedera. Raja Suzana juga didakwa gagal, abai atau cuai untuk memenuhi janji selepas tanah itu dipindah milik dan gagal melaksanakan tanggungjawab menafkahi plaintif iaitu nafkah furu'.

Hakim kemudian menetapkan 24 Februari depan untuk membuat taksiran yang sama terhadap suaminya.

Say no to the word "Boring"
It never fails to amazes me how young people become so bored with their life... with so much energy and time.. how can they ever feel boring? Stop wasting time on how you should look, what to wear, how to look fairer, how to find the perfect boyfriend/girlfriend. The media is turning you from somebody into someone with nothing in your brain and soul. After all, God does not look at ur physical at all (he made it, so it must be PERFECT)... he looks at ur heart and deeds. So tell me, what good deeds have u done lately? How much have u give back to ur family? ur Islamic community? ur kampung? ur country? What have u contributed to the society... Stop giving excuses and do something with your life.

THINGS YOU CAN DO:

Be more knowledgable:

READ
Be informative. Give some credit to ur brain... You need to feed ur brain by giving more knowledge... you guys are not SPM leavers... u are university students... Being knowledgable does not mean that u have to read thick books. You can read the newspapers for instance. And if you want to boost your brain power, don't just read.. THINK. Think how come such problems exists, what solutions can be done to overcome it. Start by a simple step: read the newspapers. If u enjoy it, next would be reading stuff on the internet

WATCH
I have nothing against watching drama melayu or cerita seram. But how about watching Animal Planet or Myth Busters or even Oprah sometimes. Come on, ur not a kid anymore. U can watch these things or interesting You Tube videos. You should be able to look and feel that how God is so greeaat in making his creations. Each of His creations are truly amazing. I know teenagers feel easily depressed... but if u know the way God works, u should be able to stop suicidal thoughts in your heads, right?

BLOOD AND ORGAN
I would encourage my students to donate their blood and organ.. Although you are not a minor anymore, above 18 and can make decisions for urself, u should consult with your parents first.
For those who say u dont have any money to donate to the community... u can always donate ur blood. Pain? Which is better... u feeling a bit of pain or some kid dies because of shortage of blood? I myself am an organ donor. I mean, think logically. When u die, ur organs would just rot. Now u have the choice of letting it rot, or keeping 5 people alive with ur organs. I prefer to see it as amal jariah... u know? the deeds that will continue even though you are dead. U can donate organ by filing up online forms..

MAKE FULL USE OF YOUR SKILLS
Madam dulu ada buat bookmarks sendiri with my friends and we all jual for MERCY Malaysia. Dpt quite a lot.We also went to help pack brg2 utk send masa tsunami dulu. Boleh jugak buat button badge and sell them. Bake cookies/cakes/cupcakes. Buat jumble sale. Sometimes it is more fun utk buat these fund raising activities. Plus, u give back to the society.

MINGLE WITH OTHERS
You would be suprised of the things u get to know when u talk with people of different races, religion and ages. Stop sticking with your cliques and join and mingle with other people. I got a lot of Chinese Indians, even international friends. And each friend will give me a different lesson/values/principles to hold on into. Join human right camps/ international camps. That would be good exposure for u.

LEARN NEW SKILL
You are young. You can take up any sports, or martial arts even (madam dulu silat..kiki)... Take a skill... masak ke, jahit ke, computer graphics ke (madam amek kursus Adobe Photoshop)... Or tambah skill baca Quran ke. What is stopping u but your own self?

I think these would be enough activities for u.... at least for know. They say GREAT TEACHERS CHANGE THE WORLD. But I would begin with my students, one by one. Better person, better muslims, insya Allah. Go and save the world!

LIBRARY QUIZ
Please do your library quiz and submit it to general office by ten on Monday. I think there is a section yg mdm belum pulangkan kertas tu so that section can do it on monday and submit on Tuesday.

And ada yg tak reti guna lexis nexis... dah bukak lexis tapi tak reti cari... tu skill la... kalau dah biasa guna facebook, friendster, no excuse tak reti nexis... u must surf lexis, try click sana sini baru tau apa ada dlm tu.

Ramachandran and Lim are neighbours with a wooden fence separating their gardens. In Ramachandran’s garden there are flower beds adjacent to the fence while Lim grows vegetables adjacent to the fence in his garden.

In an attempt to eradicate the weed in his flower beds, Ramachandran purchased a powerful weed killer called ‘Slaughter’. Warnings on the canister stated that ‘Slaughter’ was poisonous to humans and also clearly stated on it “Wash hands thoroughly after use”.

Ramachandran sprayed ‘Slaughter’ liberally on his flower beds. However, later that day, rain washed some of the weed killer under the fence onto Andrews’ vegetable patch. A crop of Cabbage growing there showed no visible signs of damage. Some of the cabbage was eaten by the Lim’s family that evening. The next day Lim’s 5 year-old son, Jordon, began to complain of stomach pains and was seriously ill and admitted into the Subang Jaya Specialist Hospital.
